Confidential DNA Sample Collection in Cases of Sexual Assault
Introduction
Under indications of damage to health as a result of maltreatment, sexual abuse, or rape, persons with statutory health insurance are entitled under Section 27 (1) sentence 6 of the German Social Code, Book V (SGB V) to services for the confidential collection of evidence, including the documentation, proper storage of the samples collected, and the necessary laboratory tests.
The task of securing evidence can be performed by approved hospitals within the meaning of Section 108 of the German Social Code, Book V (SGB V), contract physicians, approved medical care centers, and forensic medicine institutes.
The trace material secured by the service providers is usually stored at the regional forensic institutes for a period of 6 to 12 months.
